Preamble
1. The company ADAM TAXI LYONNAIS, a SARL with a share capital of €367,402.13, whose registered office is located at 83, Rue Jean Jaurès, BRON (69500),France, registered with the Lyon Trade and Companies Register under number 788.376.903, operates a radio taxi dispatch centre under the TAXI LYONNAIS brand, to which independent taxi drivers are affiliated.
2. TAXI LYONNAIS puts the CUSTOMER in contact with the affiliated Lyon taxi drivers, who carry out, on their own behalf and under their own responsibility, the transport services requested by the CUSTOMER.
3. TAXI LYONNAIS is a radio taxi dispatch centre; it employs 20 people, including 10 operators who answer calls every day, 24 hours a day, to handle taxi requests in LYON and its region. 150 independent drivers are affiliated with TAXI LYONNAIS and work on their own behalf.
4. Equipped with high-performance on-board computer and radio equipment connected to a dispatch centre, the affiliated taxis can be located at any time by the radio taxi dispatch centre. For each request, this makes it possible to quickly select and assign the available vehicle closest to the CUSTOMER's pick-up point.
Article 1: Acceptance of the General Terms of Use
5. All bookings placed with our operators are subject without reservation to these general terms. These general terms represent the entirety of the mutual commitments of TAXI LYONNAIS and the CUSTOMER, who expressly accepts them.
6. The data recorded by TAXI LYONNAIS constitutes proof of all transactions entered into between TAXI LYONNAIS and the CUSTOMER.
Article 2: Taxi bookings
7. Taxi bookings may be made as an immediate request or as an advance request:
- by telephone on +33 4 78 26 81 81,
- or by fax on +33 4 72 81 12 11,
- or online, by completing the appropriate request form available on this website.
§ 2.1 Immediate requests
8. After specifying that the request is immediate, the CUSTOMER must inform the operator of any particular features of the ride. TAXI LYONNAIS then immediately analyses the number of taxis available in the requested area and the surrounding areas.
9. If a taxi is available, TAXI LYONNAIS gives the CUSTOMER an estimated arrival time for the taxi, depending on taxi availability, and immediately starts searching for a vehicle.
10. If no driver is available in the requested areas, TAXI LYONNAIS invites the CUSTOMER to renew the request later.
§ 2.2 Taxi booking
11. A taxi booking consists of the recording by TAXI LYONNAIS of a taxi request placed by the CUSTOMER, no more than seven (7) days in advance and up to forty (40) minutes before the time of travel.
12. A taxi booking does not correspond to the reservation of an identified taxi, but to the registration of a taxi search scheduled by TAXI LYONNAIS to be carried out twenty (20) to thirty (30) minutes before the planned departure time.
13. In certain situations that are particularly difficult due to external factors, such as strikes, demonstrations, weather conditions, heavy or slow traffic, etc., TAXI LYONNAIS reserves the right to refuse certain advance requests if the chosen time slot is already full, and in that case informs the CUSTOMER of the available time slots.
14. If no taxi has arrived five (5) minutes after the planned departure time, the CUSTOMER is invited to call the TAXI LYONNAIS switchboard on the following telephone number: +33 4 78 26 81 81, which will provide all useful information on the arrival of the taxi or on the status of the taxi search, and will do everything possible to satisfy the request as quickly as possible.
§ 2.3 Request for an identified taxi
15. A request for an identified taxi consists of the recording and provision of a taxi by TAXI LYONNAIS following a request for an identified taxi by the CUSTOMER. This type of ride must be scheduled as early as possible so that we can manage our availability as effectively as possible.
16. A request for an identified taxi guarantees the customer the presence of a taxi at the planned place and time. The provision of the appropriate vehicle and driver may be subject to a surcharge on the taxi fare. This surcharge is the result of a negotiation between the TAXI LYONNAIS sales representative and the CUSTOMER.
§ 2.4 Passenger pick-up
17. The CUSTOMER must get into the taxi as soon as it arrives at the stated address in the case of an immediate request, or at the agreed time in the case of an advance request. If the passenger is absent five (5) minutes after this time, the taxi driver is deemed authorised to leave without prior notice.
§ 2.5 Abandoned booking – Passenger not picked up
18. Any journey made by a taxi that cannot find the CUSTOMER, or whose pick-up the CUSTOMER refuses under the terms of these general terms, must be paid to the driver for the amount shown on the meter. If direct payment to the assigned driver is not possible, TAXI LYONNAIS will send, by post to the CUSTOMER or to the caller, an invoice for the unfulfilled ride on behalf of that driver, which the CUSTOMER undertakes to pay to TAXI LYONNAIS upon receipt.
Article 3: Pricing conditions for telephone bookings
19. The services of TAXI LYONNAIS are free of charge for the CUSTOMER. The transport service is paid directly by the CUSTOMER to the taxi driver, according to the fare scales in force.
Article 4: Liability of TAXI LYONNAIS
20. The liability of TAXI LYONNAIS is limited to the service of searching for a taxi at the address stated by the CUSTOMER.
21. TAXI LYONNAIS uses all the means at its disposal to find an available taxi for the CUSTOMER as quickly as possible.
22. TAXI LYONNAIS may not be held liable in the event of force majeure and, more generally, in the following cases: IT maintenance, IT or telecommunications network failure, strike, demonstration, bad weather, traffic accident disrupting normal traffic, or unusually heavy traffic congestion.
23. TAXI LYONNAIS puts the CUSTOMER in contact with the affiliated taxi drivers, who carry out, on their own behalf and under their own responsibility, the transport services requested by the CUSTOMER.
24. The performance of the transport service, from boarding to alighting from the vehicle, is the sole responsibility of the taxi driver. In the event of a delay caused by the taxi driver who accepted the ride, or of non-performance or poor performance of the ride by that driver, TAXI LYONNAIS may not be held liable.
Article 5: Personal data
25. The CUSTOMER's personal data is collected by TAXI LYONNAIS for the purposes of proper booking management and in compliance with the provisions of the French "Informatique et Libertés" Act No. 78-17 of 6 January 1978. In particular, the CUSTOMER is informed and accepts that TAXI LYONNAIS reserves the right to record and retain, for evidential purposes, all information relating to calls received by its telephone platform and to taxi rides, and more particularly:
- the telephone number presented by the CUSTOMER,
- the recording of the telephone conversation,
- the details of the data relating to the requested ride.
26. The CUSTOMER has at all times the right to access, modify, rectify and delete the personal information collected about them by TAXI LYONNAIS, in accordance with the provisions of Article 34 of the French "Informatique et Libertés" Act No. 78-17 of 6 January 1978. To exercise this right, the CUSTOMER must write to TAXI LYONNAIS, 83, Rue Jean Jaurès, 69500 BRON, France.
Article 6: Online taxi bookings
27. In addition to its telephone platform, TAXI LYONNAIS manages taxi bookings recorded through this website.
28. Booking a taxi through the TAXI LYONNAIS website is subject to the following conditions.
§ 6.1 Online booking procedure
29. Taxi bookings may be made as an "immediate request" (see § 2.1) or as an "advance request" (see § 2.2).
30. The CUSTOMER must complete the required registration steps in order to book online, by filling in the "mandatory fields".
31. The online booking service is also free of charge.
§ 6.2 Applicable law
32. All bookings placed on this website are governed by French law. In the event of a dispute concerning the interpretation, performance or completion of any of the services booked online, the dispute shall, failing an amicable settlement, and if the CUSTOMER is a trader, fall within the exclusive jurisdiction of the Commercial Court of LYON.
Article 7: "Estimate your fare!" service
33. By using the "Estimate your fare!" service, the CUSTOMER acknowledges that they have read and accepted the terms of use of the Google Maps service.

Article 8: Amendment of the General Terms of Use
34. TAXI LYONNAIS reserves the right to amend these general terms of use of its services at any time, without prior notice.
